Captain's Liability Agreement

1. Captain's Role and Responsibilities

As a captain on the Captain Share platform, you acknowledge and agree that:

1. You are an independent contractor and not an employee, partner, or agent of Captain Share.
2. You are solely responsible for the services you provide to boat owners and passengers.
3. You will maintain all required licenses, certifications, and insurance as required by applicable laws and regulations.
4. You will operate vessels safely and in compliance with all applicable laws, regulations, and maritime rules.
5. You will not consume alcohol, drugs, or any substances that may impair your ability to safely operate a vessel while providing services.
6. You will conduct yourself professionally and provide high-quality service to all customers.

2. Captain Share's Role

Captain Share's role is limited to:

1. Providing a platform that connects qualified captains with boat owners.
2. Verifying basic credentials and certifications provided by captains.
3. Facilitating communication and booking between captains and boat owners.
4. Processing payments between parties.

Captain Share does not:

1. Employ captains or control how they provide their services.
2. Own, operate, or maintain any vessels.
3. Guarantee the quality or safety of services provided by captains.
4. Assume liability for the actions or omissions of captains.

3. Liability and Indemnification

As a captain, you agree to:

1. Assume full responsibility and liability for your actions and services.
2. Maintain appropriate insurance coverage, including liability insurance.
3. Indemnify and hold harmless Captain Share, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from your services or breach of this agreement.
4. Resolve any disputes directly with boat owners or passengers.

4. Safety Standards

As a captain, you commit to:

1. Prioritize safety above all else during your operations.
2. Conduct thorough safety briefings for all passengers.
3. Ensure all safety equipment is present and in working order before departing.
4. Monitor weather conditions and avoid unsafe boating conditions.
5. Adhere to all capacity limits and operating restrictions for the vessel.
6. Maintain zero tolerance for alcohol or substance use while operating a vessel.

5. Quality Standards

Captain Share expects all captains to:

1. Provide professional, courteous, and high-quality service.
2. Be punctual and reliable for all bookings.
3. Communicate clearly and promptly with boat owners and passengers.
4. Maintain vessels in clean and proper operating condition.
5. Address any customer concerns or issues promptly and professionally.

6. Termination

Captain Share reserves the right to terminate a captain's access to the platform for:

1. Violation of this Captain's Liability Agreement.
2. Violation of our Terms of Service or other policies.
3. Failure to maintain required licenses, certifications, or insurance.
4. Receiving consistent negative feedback or complaints.
5. Any behavior that poses a safety risk or damages the reputation of Captain Share.
6. Any use of alcohol or substances while operating a vessel.

7. Acknowledgment

By using the Captain Share platform as a captain, you acknowledge that you have read, understood, and agree to this Captain's Liability Agreement. You understand that Captain Share is a platform that facilitates connections between captains and boat owners, and that you are solely responsible for the services you provide.
