Welcome to Captain Share ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Captain Share website, mobile application, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. The Captain Share Platform

Captain Share is a platform that connects boat owners with qualified captains. We do not own, sell, resell, furnish, provide, rent, or operate vessels, nor are we a captain service provider. Our Services are limited to facilitating the connection between boat owners and captains.

3. Account Registration

To use certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Captain Services

4.1 Captain Qualifications: All captains on our platform must meet certain qualifications, including possessing valid certifications and licenses as required by applicable laws and regulations.

4.2 Captain Liability: Captains are independent contractors and not employees of Captain Share. Captains are solely responsible for their actions, conduct, and the services they provide. Captain Share merely facilitates the connection between boat owners and captains.

4.3 Captain Obligations: Captains agree to provide services in a professional manner, comply with all applicable laws and regulations, maintain valid certifications and insurance, and adhere to our safety standards and policies.

5. Boat Owner Services

5.1 Boat Owner Responsibilities: Boat owners are responsible for ensuring their vessels are in proper working condition, properly registered, and comply with all applicable laws and regulations.

5.2 Vessel Information: Boat owners agree to provide accurate and complete information about their vessels.

6. Bookings and Financial Terms

6.1 Booking Process: Bookings are made through our platform. Once a booking is confirmed, a binding agreement is created between the boat owner and the captain.

6.2 Fees: We charge service fees for the use of our platform. These fees are clearly displayed before booking confirmation.

6.3 Cancellations: Cancellation policies are specified at the time of booking. Refunds, if applicable, will be processed according to these policies.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations
• Infringing on the rights of others
• Providing false or misleading information
• Using the Services for any illegal or unauthorized purpose
• Interfering with or disrupting the Services
• Attempting to gain unauthorized access to the Services

8. Limitation of Liability

To the maximum extent permitted by law, Captain Share shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9. Indemnification

You agree to indemnify, defend, and hold harmless Captain Share and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your use of the Services
• Your violation of any rights of another

10. Modifications to the Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will provide notice through our Services or by other means. Your continued use of the Services after such notice constitutes your acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions.
